By accessing or using FreshPosts (freshpostspro.com), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the platform. These terms apply to all users, including visitors, free trial users, and paying subscribers.

2. Description of Platform

FreshPosts is an AI-powered blog content platform that generates, optimizes, and publishes SEO blog posts directly to your WordPress website. The platform handles keyword research, content writing, schema markup, and automatic publishing. FreshPosts is software that automates content creation and publishing workflows for small businesses.

3. Account Registration

To use FreshPosts, you must create an account through our authentication provider (Clerk). You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity under your account

You must be at least 18 years old to create an account. One account per person or business entity.

4. Subscription Plans

• FreshPosts offers multiple subscription tiers as displayed on our pricing page
• Plans are billed monthly and auto-renew at the beginning of each billing cycle
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• The 2 free trial posts require no payment information and carry no obligation
• Plan features, post limits, and add-on availability are as described on the pricing page at the time of subscription

5. Content Ownership

You own all content generated by FreshPosts for your business. Specifically:

• All blog posts, audio overviews, and video summaries created for your account are your property
• FreshPosts retains no rights to your published content
• Content remains on your website even after you cancel your subscription
• You may edit, republish, or remove any content we have published to your site

FreshPosts may use anonymized, aggregated performance data (such as average word counts or topic categories) to improve the platform. This data will never identify you or your business.

6. AI-Generated Content

Content produced by FreshPosts is AI-assisted and passes through automated quality checks including SEO scoring, readability analysis, and factual verification steps. You acknowledge that:

• FreshPosts does not guarantee specific search engine rankings, traffic volumes, or revenue outcomes
• SEO results depend on many factors outside our control, including domain authority, competition, and search algorithm changes
• You should review content before or after publishing; Growth plan and above include pre-publish review features
• AI-generated content follows Google's published guidelines for helpful, people-first content

7. WordPress Integration

To publish content to your website, you grant FreshPosts permission to access your WordPress site via Application Passwords. You acknowledge that:

• FreshPosts will create and publish blog posts on your behalf
• FreshPosts will not modify existing content, themes, plugins, or site settings
• You can revoke FreshPosts' access at any time by deleting the Application Password in your WordPress dashboard
• You are responsible for maintaining your WordPress installation, hosting, and backups

8. Acceptable Use

You agree not to use FreshPosts to:

• Generate content that is illegal, defamatory, or violates any applicable law
• Produce spam, misleading content, or content designed to manipulate search rankings through deceptive practices
• Create content that infringes on the intellectual property rights of others
• Publish content promoting dangerous, harmful, or fraudulent activities
• Misrepresent your business, credentials, or qualifications in generated content

FreshPosts reserves the right to suspend or terminate accounts that violate these guidelines.

9. Payment Terms

• All payments are processed securely through our payment provider, who acts as the Merchant of Record for all transactions.
• Prices are displayed in GBP, USD, or EUR depending on your location; the final billing currency is confirmed at checkout.
• Subscriptions auto-renew monthly; you will be charged at the start of each billing period.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• Refund requests are handled by Paddle in accordance with their refund policy. See our Refund Policy for details.
• The 2 free trial posts require no payment information.
• Failed payments will result in a grace period of 7 days before account suspension.
• We reserve the right to change pricing with 30 days' written notice.

10. Data Protection

We take your privacy seriously. Please refer to our Privacy Policy for detailed information about how we collect, process, and protect your data. FreshPosts is committed to GDPR compliance for all users, regardless of location.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• FreshPosts' total liability for any claims arising from your use of the platform is limited to the total amount you have paid to FreshPosts in the 12 months preceding the claim
• FreshPosts is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities
• FreshPosts is not liable for any loss or damage arising from circumstances beyond our reasonable control, including third-party platform outages, search engine algorithm changes, or WordPress hosting failures

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

• You may cancel your subscription at any time through your account dashboard or by contacting support
• FreshPosts may terminate your account for violation of these terms, with notice where practicable
• Upon termination, all published blog posts remain on your WordPress website
• Account data will be retained for 30 days after termination, then permanently deleted

13. Changes to Terms

We may update these Terms & Conditions from time to time. For material changes, we will provide at least 30 days notice via email to the address associated with your account. Continued use of the platform after the effective date of changes constitutes acceptance of the updated terms. The "Last updated" date at the top of this page reflects the most recent revision.

14. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights under mandatory consumer protection laws in your country of residence.
